Manila: The Supreme Court (SC) has denied the Duterte Youth party-list’s request for a temporary restraining order (TRO) against the Commission on Elections’ (Comelec) decision to cancel its registration.
According to Philippines News Agency, in a resolution dated September 30 and made public on Monday, the SC en banc dismissed the group’s appeal for a TRO, writ of preliminary injunction, and status quo ante order. The court also turned down the party-list’s motion for a special raffle.
The SC has instructed Comelec and other respondents in the case to submit their comments within 10 days. The Duterte Youth party-list had challenged two Comelec resolutions: the June 18 resolution that canceled its registration and the August 29 resolution that reaffirmed the cancellation and dismissed the group’s motion for registration.
Comelec’s decision to revoke the Duterte Youth’s registration stems from a 2019 petition that questioned the legitimacy of the party-list’s 2018 registration. The petitioners argued that the group’s registration application was not published in at least two newspapers of general circulation, and there was no proper hearing conducted on its application for accreditation, as mandated by the Party-list System Act.
